Stake.us set to Leave Illinois 7 months After Sweepstakes Ruling

Many sweepstakes casino operators were advised in February by the Illinois Gaming Board and Attorney General Kwame Raoul via cease-and-desist letters to leave Illinois. The list included Stake.us, Chumba, Global Poker, Fliff, Pulsz, McLuck, WOW Vegas and dozens more. This week, Stake.us, one of the biggest names on it, announced it’s moving Illinois accounts to redeem-only mode. Most coverage will treat that as the crackdown working. I’m more interested in how long it took. By May, only two of the 65 operators, JefeBet and Jumbo88, had geoblocked Illinois. Stake took more than seven months, and it’s still the most prominent name to leave.

    The board’s position has been clear from the start. Illinois allows gambling at licensed riverboats, casinos, racetracks, sportsbooks and video gaming terminals, and sweepstakes casinos don’t fit into any of those categories. The IGB’s view is that any dual-currency platform offering cash-redeemable prizes to Illinois residents is running an illegal online casino under the state’s criminal code. Administrator Marcus Fruchter said such operations “threaten consumer protections, undermine responsible gaming safeguards, and are antithetical to the public’s interest in regulated gaming.” The letters threatened civil and criminal penalties for operators that didn’t block the state. The industry mostly ignored them anyway.

    What I keep coming back to is how little a letter does on its own. Stake isn’t leaving Illinois because of a letter from February. It’s leaving because enforcement against sweepstakes has picked up nationwide. On Sept. 9, New York AG Letitia James got $8 million from VGW over Chumba, Global Poker and LuckyLand. VGW shut down LuckyLand Slots entirely on Sept. 14. Louisiana’s ban took effect Aug. 4 and classifies dual-currency casino games as “gambling by computer.” California’s AB 831 extends liability to payment processors, geolocation providers, game suppliers and affiliates, with fines up to $25,000 per violation. Once regulators start going after settlements and the payment and content companies these platforms depend on, the risk of staying in a state like Illinois changes. Stake was ordered out in February, but it’s leaving now because of what happened in September.

    The details of the exit matter too. Redeem-only mode means Illinois players can still log in and cash out Sweeps Coins, but purchases, games, promotions and new Stake Cash codes all go away. That’s an orderly shutdown, not a sudden one, and it’s the version of leaving that best protects the company from customer complaints and regulators. Meanwhile, McLuck, CrownCoins and RealPrize were reportedly still operating in Illinois after getting the same letter. That’s the problem with enforcement that relies on operators choosing to comply. Each operator that leaves just sends its customers to one that stayed.

    Stake’s exit is a real win for the IGB, but it doesn’t mean the approach worked. It took seven months, one of 65 targets, and pressure from other states for the biggest name to leave. Illinois has no legal online casino market, so players who leave Stake don’t move to a regulated product. They move to another sweepstakes site or to an offshore one. If Illinois wants its letters to be taken seriously, the next step has to look like New York’s or California’s: settlements, penalties, and liability for the companies that process these platforms’ payments and supply their games.
