Senate Kills the Crypto Bill, 49-50

The Senate fell short 49-50 on the CLARITY Act's cloture vote, effectively killing US crypto market structure legislation for 2026. Here's what that means for the crypto sportsbooks and casinos already operating in the gray zone it would have closed.

The number was 60. They got 49. Susan Collins voting no from the Republican side alone was enough to sink it before the rest of the count even mattered. Cynthia Lummis, who wrote the thing, had already told reporters this morning that a failed vote meant the whole effort was done for the year — not delayed, done. So that’s it: more than a year of markup sessions, a 294-134 House vote back in 2025, a White House event where Trump himself leaned on Congress to pass it, and the Senate couldn’t even get a bare majority behind a procedural motion, let alone the supermajority it needed.

I’ve made this point before about prediction markets specifically, but it applies here too: the entire reason crypto exchanges get away with calling themselves commodities markets instead of gambling products is that nobody in Washington has forced them to pick a lane. CLARITY would have done exactly that — CFTC gets this, SEC gets that, DeFi gets defined, stablecoins get rules. Instead everyone goes back to the same setup that’s been running for years, where what’s legal depends on which agency feels like enforcing something that month.

The part that actually matters if you’re running or using a crypto sportsbook: nothing changes tomorrow. You’re not filing new paperwork, nobody’s rewriting how a Bitcoin deposit hits your account, and the KYC form is staying exactly as annoying (or not annoying) as it already was. The platforms that have built their whole model around fast crypto payments and minimal friction keep doing exactly that, probably through the midterms and honestly probably into 2027. I know that reads like bad news dressed up as good news, and maybe it is a little. But if you’re an operator, less regulation this year is less regulation this year. Nobody’s pretending otherwise.

What actually stings, if you’re the crypto lobby, is what this says about your leverage. These guys spent something like $100 million backing pro-crypto candidates in 2024. They had a friendly White House, a bill that already cleared the House with 78 Democrats attached, over a year of Republicans caving to ethics demands — and they still couldn’t find eleven more votes. That’s not a rounding error. That’s a ceiling. And it’s hard to see why the math gets any easier next year with an election in between.

So the crypto betting world just keeps doing what it’s been doing. Same rules, or lack of them. Same operators. Check back in 2027, probably.
